Show Photography Session Agreement

The client assumes all responsibility for their animal(s) or any other subjects during the session, including any and all destruction of personal, business or public property, personal injury or illegalities.

Photographer is not responsible for photographs not taken due to uncooperative animals, or other acts that cannot be controlled by photographer.

Model Release

I, the client, have the legal right and authority to execute this release on behalf of the subject(s). I hereby irrevocably authorize Maine Chinchilla Ranch, LLC, and its assignees, licensees, legal representatives and transferees to use and publish (with or without my name, the animal’s name, or with a fictitious name) images of the subject(s) in any and all forms of media, for the purpose of self-promotion, publicity, publishing (including electronic forms as internet websites), resale as prints or other media for commercial use, or in photographic contests or gallery shows. I waive any and all rights to review or approve any use of the images for the above-mentioned purposes. Maine Chinchilla Ranch, LLC agrees to never use the images in a manner which is slanderous, demeaning, or hurtful in any way to me or any of the subjects.

I, the client, warrant that I have authority to agree to the use of the likeness of all persons included in the session in this manner and shall indemnify and defend Maine Chinchilla Ranch, LLC in the event of litigation arising out of such use.

Copyright

The client may use the produced and processed images of animals belonging to the client and distributed to the client for unrestricted commercial or personal use but also allows Maine Chinchilla Ranch, LLC (The Chinchilla Club) unrestricted use of these images and the original RAW files for thier publications and products.

The Artist’s (Maine Chinchilla Ranch, LLC) rights are protected by the Federal Copyright Act of 1976 and the Federal Visual Rights Act of 1991. Purchase of a copyrighted artwork does not transfer the copyrights. The copyright to reproduce the works in copies, to produce derivative work based on the copyrighted image, and distribute copies is retained by the artist. Any transfer of this copyright must be in writing expressly identifying what rights are being sold and for what purpose.

Artist will own the copyright and the right to show the piece in his portfolio, and will retain slides/computer files/pictures of it for use in exhibits, competitions, websites, blogs or printed products, etc. However, artist agrees to maintain the anonymity of the subject if requested.

Distribution

The client will receive a watermarked and processed digital copy of session images within 7 days of the photography session via email in .jpg format to their email box. The client is responsible for receiving and handling the files. The email address provided by the client will not be used for any other purpose than to send the images or provide statuses regarding matters of this photography session without permission.

Processing

Digital Processing may include color and exposure correction, removal of debris in the scene, sharpening, background removal, eye cleanup, cataract removal or other such enhancements.

Additional processing or image formats can be requested and performed for an additional fee. This may include removal of objects (such as a hand or arm in the photo used in positioning the animal), compositing multiple animals into a photo, changing the color of objects, etc. Contact Us to request a quote.

We will not distribute photos to clients such that processing intentionally misrepresents an animal’s quality in regards to judging standards. Any changes made in processing that may alter the appearance of quality are coincidental and are purely for aesthetic reasons.
